PRIVACY POLICY — FITCOOK WEBSITE AND APPLICATION

This Privacy Policy describes how FitCook Foodz ("FitCook," "we," "us," or "our") collects, uses, discloses, retains, and protects your personal information when you use:
• our website, including fitcookfoodz.com, our online store, and other pages or domains that we operate (the "Website");
• the FitCook mobile and web application (the "Application");
• our community features, recipes, cooking classes, rewards, notifications, customer service, and other related services;
• our communications, promotions, and interactions with you.
The Website, Application, and related services are collectively referred to as the "Services."
By using our Services, you acknowledge that you have read this Privacy Policy. Where required by law, we will ask for your consent before collecting, using, or disclosing your personal information. You may withdraw your consent where permitted by law, subject to reasonable notice and any consequences that will be explained to you at the time of your request.
1. PERSONAL INFORMATION WE COLLECT
Personal information is information about an individual that directly or indirectly identifies that individual. The information we collect depends on how you use the Services.
1.1 Account and identity information
When you create or use a FitCook account, we may collect:
• your first and last name;
• your email address;
• your password, stored in a protected and unreadable form;
• your preferred language;
• internal identifiers associated with your account;
• your date of birth, biography, profile photo, or avatar, when you choose to provide them;
• your account status, consent choices, and preferences.
The email address associated with your FitCook account may be used to find, create, or link your Shopify customer profile to facilitate purchases, subscriptions, rewards, and your checkout experience. For certain features, including customer-restricted discount codes, to work properly, you may need to use the same email address in the Application and during Shopify checkout.
1.2 Device information and Website usage
When you visit the Website, certain information is collected automatically, including:
• your web browser version;
• your IP address;
• your time zone;
• information from cookies or similar technologies;
• the pages, products, or content you view;
• your search terms;
• your interactions with the Website;
• the websites or links that referred you to us;
• navigation, performance, and analytics data.
This information may be collected using cookies, log files, web beacons, pixels, tags, or similar technologies. It is used to display the Website correctly, understand its use, prevent fraud, and improve our Services.
1.3 Technical information and Application usage data
When you use the Application, we may automatically collect certain technical information, including:
• device type, operating system, Application version, and language;
• IP address, session identifiers, and authentication data;
• screens and features used;
• errors, technical logs, diagnostics, security, and performance data;
• the date, time, and duration of certain interactions;
• data required for push notifications to function.
We use this information to provide, secure, diagnose, measure, and improve the Application.
1.4 Order, payment, and subscription information
When you make a purchase, start a subscription, use a discount code, or interact with the store, we may collect or receive:
• your name;
• your billing and shipping addresses;
• your email address and telephone number;
• products viewed, added to your cart, or purchased;
• order, delivery, tax, invoice, and confirmation information;
• the status of a payment, subscription, renewal, cancellation, refund, or delivery;
• discount codes obtained, used, expired, or refunded;
• information required to prevent fraud and resolve order-related issues.
Payment information, including credit card numbers or other financial information needed to process a transaction, is collected and processed by Shopify and the applicable payment providers. FitCook generally does not receive your full payment card number and does not store it in the Application.
We use order information to provide the requested products or services, process payments, arrange shipping and delivery, issue invoices and confirmations, communicate with you, manage subscriptions and refunds, review orders to prevent fraud, and, where you have consented, present promotional offers.
1.5 Activity in the Application
Depending on the features you use, we may collect:
• your favourite recipes, saved content, and preferences;
• your course enrolments, lesson progress, and viewing activity;
• your points, milestone progress, spendable points balance, rewards, and points transaction history;
• rewards or discount codes you claim, their expiry date, and their redemption status;
• your notification preferences;
• actions needed to personalize your experience and present relevant content.
Points and rewards rules may be applied automatically, for example to add or remove points following a purchase, refund, or reward redemption. You may contact us if you believe a transaction was applied incorrectly.
1.6 Community content and public interactions
When you use community features, we may collect and process:
• your posts, text, comments, images, and other content;
• your likes, reports, and interactions;
• moderation, approval, or removal information;
• the name, avatar, and other profile information displayed with your contribution.
Approved posts, comments, author names, avatars, images, and related interactions may be publicly visible, including to people who are not signed in to an account. Do not post information that you do not want to make public. We may review, moderate, reject, or remove content to enforce our rules, protect users, or comply with our legal obligations.
1.7 Photos and files
When you choose a profile picture or add an image to a post, the Application may request permission to access the photos or files you select on your device. We collect only the files that you choose to submit. The current version of the Application does not use your contacts, precise location, or microphone to provide its core features. If this changes, we will request the necessary permissions and update this Privacy Policy.
1.8 Videos and cooking classes
When you watch a video or take a course, we may collect data such as:
• the video or lesson identifier and title;
• your user identifier when you are signed in;
• video starts, progress, viewing duration, and completion;
• playback events, errors, and video performance data.
This information allows us to deliver videos, save your progress, resolve technical issues, and improve our courses. Our video delivery and analytics provider may receive some of this information.
1.9 Push notifications
If you enable push notifications, we may collect a notification token associated with your device and your notification preferences. We may send notifications relating, for example, to your account, orders, rewards, community activity, newly published recipes, or newly available courses.
You can change your preferences in the Application and disable notifications in your device settings. Certain communications necessary for a transaction, service operation, or security may continue to be sent by email when required.
1.10 Communications, newsletter, and customer support
When you contact us, we may collect the details of your request, the content of your communications, and the information needed to respond and provide support.
If you subscribe to our newsletter or agree to receive commercial communications, we may collect your email address, preferences, and interactions with our messages. You may unsubscribe using the link included in our communications or by contacting us. Withdrawing consent to promotional messages does not prevent us from sending necessary transactional or service communications.
2. SOURCES OF INFORMATION
We collect personal information:
• directly from you, including when you create an account, complete a form, make a purchase, publish content, or contact us;
• automatically when you use the Website or Application;
• from Shopify and providers involved in orders, payments, subscriptions, refunds, and deliveries;
• from technology, analytics, communications, security, or support providers;
• from advertising partners or social networks, where permitted by law and subject to your privacy choices;
• from publicly available information or information that you have made public.
3. WHY WE USE YOUR INFORMATION
We use your personal information to:
• create, manage, authenticate, and secure your account;
• provide and operate the Website, Application, and their features;

• ship and deliver orders;
• manage subscriptions, renewals, cancellations, and refunds;
• administer points, milestones, rewards, and discount codes;

• prevent fraud, abuse, and security incidents;

• establish, exercise, or defend our rights and those of our users.
Depending on the context, we process your information with your consent, to provide the Services or perform a contract with you, to comply with a legal obligation, or to pursue a legitimate interest permitted by law, such as security, fraud prevention, and improvement of our Services.
4. DISCLOSURE OF PERSONAL INFORMATION
We do not sell your personal information in the ordinary meaning of the word. We may disclose it to providers that help us operate the Services, only to the extent necessary for their functions, including:

• payment gateways, carriers, shipping applications, and order management providers;
• Klaviyo or other communications providers when you subscribe to our commercial communications;
• Loox or other customer review tools, including to display reviews and send invitations to submit a review after a purchase;
• Mux or other video delivery, hosting, and analytics providers;
• Cloudflare, including for the storage or delivery of files and images;
• Expo, Apple, and Google, as needed to deliver push notifications;
• Resend or other transactional email providers;
• Google Analytics and other Website measurement or analytics providers;
• Meta/Facebook, Google, Microsoft/Bing, and other advertising or measurement partners, depending on accepted cookies and your preferences;
• hosting, storage, monitoring, security, technical support, and customer service providers;
• professional advisers, including our lawyers, accountants, insurers, and auditors;
• a prospective purchaser, investor, or successor in connection with a restructuring, financing, merger, sale, or other business transaction, subject to appropriate safeguards.
We may also disclose personal information when necessary to comply with a law or regulation, respond to a court order, subpoena, or valid legal request, investigate fraud or a security incident, protect a person, or enforce our rights.
5. BEHAVIOURAL ADVERTISING AND ANALYTICS
We may use certain information about your use of the Website to measure our campaigns and present advertising or marketing communications that may interest you, subject to applicable law and your consent choices.

Information that you voluntarily post in a public area of the Services may be viewed, copied, or shared by others. We cannot control how a third party uses content that you have made public. Avoid posting sensitive information or another person’s personal information without their permission.
When you request deletion of your account, we will process account-related information in accordance with applicable law and our retention obligations. Depending on the circumstances, certain public contributions may be deleted, disassociated from your identity, or retained where required by law or necessary to preserve the integrity of a conversation.
8. AUTOMATED PROCESSING AND DECISIONS
Certain functions are performed automatically according to predefined rules, including:
• granting or removing points following an action, purchase, or refund;
• determining eligibility for a reward or discount code;
• detecting unusual or potentially fraudulent activity;
• recommending or highlighting certain content.
These processes are used to operate the Services and are not intended to make a decision that has a significant legal effect on you without human involvement. You may contact us to request an explanation or report an error.
9. RETENTION AND DELETION OF INFORMATION
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, or for any longer period required or permitted by law.
For example:
• account information is generally retained while the account is active;
• order and payment information is retained in our records and Shopify’s records in accordance with applicable tax, accounting, contractual, fraud prevention, and legal requirements;
• support information may be retained to follow up on a request and maintain service history;
• technical and security logs are retained for a period appropriate to diagnostic, fraud prevention, and security needs;
• information relating to consent, unsubscribes, and privacy requests may be retained to demonstrate compliance with our obligations.
When you request account deletion in the Application, access to the account may be revoked promptly, after which the request is verified and processed. Certain information may need to be retained or anonymized where justified by a legal obligation, transaction, fraud prevention, dispute resolution, or the defence of our rights.
When retention is no longer necessary, we securely destroy, delete, or anonymize information in accordance with applicable law and our procedures.
10. TRANSFERS OUTSIDE QUEBEC OR CANADA
FitCook is located in Quebec, but some service providers may process or store information outside Quebec or Canada. In such cases, the information may be subject to the laws of the jurisdiction where it is processed, and local authorities may have access to it in accordance with those laws.
Before disclosing personal information outside Quebec where required by law, we assess the relevant factors and implement appropriate contractual, organizational, or technical safeguards to protect the information.
11. SECURITY AND PRIVACY INCIDENTS
We apply reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, use, disclosure, modification, or destruction.
No method of transmission or storage is completely secure. If we become aware of a privacy incident, we take reasonable measures to reduce the risk of harm and prevent similar incidents. We notify affected individuals and authorities where required by law.
You are responsible for protecting your password and notifying us promptly if you suspect unauthorized use of your account.
12. YOUR RIGHTS AND CHOICES
Subject to the conditions and exceptions provided by law, you may have the right to:
• ask whether we hold personal information about you;
• request access to that information;
• request correction of inaccurate, incomplete, or ambiguous information;
• request deletion or de-indexing of certain information where permitted by law;
• withdraw your consent to certain uses or disclosures;
• change your communications and notification preferences;
• request information about the categories of persons who have access to your information and the applicable retention period;
• submit a complaint to our Privacy Officer;
• submit a complaint to the Commission d’accès à l’information du Québec or another competent authority.
We will respond to a valid request within the period required by law, generally within 30 days of receiving it. We may need to verify your identity before processing a request. If we deny a request in whole or in part, we will explain the reasons and available remedies where required by law.
You can change certain information directly in the Application. You can also request account deletion using the function provided for this purpose or by contacting us.
13. MINORS
The Services are not intended for children under 14 years of age. We do not knowingly collect their personal information without the required consent of a parent or guardian, except where expressly permitted by law. If you are a parent or guardian and believe that a child has improperly provided us with personal information, please contact us so that we can review the situation and delete the information where appropriate.
14. THIRD-PARTY LINKS AND SERVICES
The Services may contain links to websites, applications, or services operated by third parties. Their practices are governed by their own privacy policies. We encourage you to read those policies before providing them with personal information. FitCook is not responsible for the privacy practices of these third parties.
15. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy to reflect changes to our practices, Services, providers, or operational, legal, or regulatory requirements.
The updated version will be published on the Website and made available in the Application, together with the date of the latest update. Where changes are significant or required by law, we will notify you by an appropriate means and request new consent where necessary.
